Suraj Case: Prosecutor's Review Committee Decision

The Prosecutorial Review Commission, which had filed a request in April 2014, took a decision on the matter on October 28th.
"The decision not to prosecute is appropriate."

Here are some reasons:
① The immigration officials' restraining actions were within the scope of legitimate business activities and were not illegal.
② The autopsy findings indicated that the cause of death was cardiac death, and the causal relationship between the restraining action and cardiac death is unclear.
Conclusion: The moral responsibility for the delay in providing life-saving measures is worthy of criticism, but there is no justification for overturning the decision not to prosecute.

I understand that criminal and civil cases are different, but the district court ruling is not being used at all.
I feel really frustrated that the many signatures calling for compulsory prosecution we received from you all did not reach them.
Suraj's wife was left speechless by the results.
He said that although he was not convinced, he had no choice but to accept it and that the truth would have to be revealed through civil proceedings.

Although there are concerns about how this decision will affect civil matters, the appeal process is still ongoing.

The next, third hearing of the appeal will be held on January 21st from 10:30 a.m. in Courtroom 825 of the Tokyo High Court.
