Suraj case: Decision of the prosecution review board

The deliberation by the Public Prosecutors' Review Board, which I filed a request for in April 2014, was decided on October 28th.
The conclusion was, "The decision not to prosecute is appropriate."

The reasons are as follows:
① The restraint actions taken by immigration officers are within the scope of legitimate professional conduct and are not illegal.
② The cause of death, according to autopsy findings, was cardiac death, and the causal relationship between the restraint and cardiac death is unclear.
In conclusion, while the delay in life-saving measures is morally reprehensible, there are no sufficient grounds to overturn the decision not to prosecute.

I understand that criminal and civil cases are different, but the district court ruling is not being utilized at all.
I am truly disappointed to think that despite receiving so many signatures from everyone calling for compulsory prosecution, our message did not reach them.
Suraj's wife was speechless at the result.
He said that he was not happy with the outcome, but he had no choice but to accept it and that he would have to uncover the truth through civil proceedings.

I am concerned about how this decision will affect the civil case, but the appeal trial is still ongoing.

The next hearing, the third in the appeals trial, will be held on January 21st at 10:30 AM in Courtroom 825 of the Tokyo High Court.
