Ten immigration officers who accompanied Mr. Suraj on his deportation were referred to prosecutors on suspicion of assault and abuse resulting in death by public officials, but on July 3, 2012, they were not indicted.
On the afternoon of July 3, 2012, the prosecutor in charge at the Chiba District Public Prosecutors Office directly explained to Mr. Suraj's wife that there was no causal relationship between Mr. Suraj's death and the actions of the immigration officer.
The decision not to prosecute came shortly after the defendant, the government, finally submitted a written statement in the civil lawsuit for state compensation, after having previously maintained a rigid stance of reserving admission or denial. The timing was such that it made one suspect that the government and the prosecution had been colluding.
Going forward, pursuing this matter through a national compensation lawsuit may be the only way to uncover the truth.
