
On July 3, 2012, a decision was made not to prosecute the 10 immigration officers who had been referred to prosecutors in connection with Mr. Suraj's case. Mr. Suraj's wife and APFS protest this decision today with the following statement.

Urgent protest against the decision not to prosecute
We feel strong indignation at this "non-indictment" decision, which has finally been made two years after the incident.
Regarding the cause of Ms. Suraj's death, a re-examination of her preserved heart revealed a tumor, and it was determined that the resulting arrhythmia was the cause.The family had no idea that the heart was being preserved, and now, two years later, even if they are told that the heart was actually being preserved and that the death was caused by a tumor that was already in the heart, they find it hard to believe.I have doubts about whether the heart being kept is indeed Suraju's, and whether the appraisal is reliable.
The immigration officer's actions against Suraj were deemed to be within the scope of legitimate conduct.Given that video recording was stopped and no record was left, it's difficult to say how they determined that the actions fell within the scope of legitimate conduct; it's simply a judgment based on the immigration authorities' unilateral claims.I fear that in the future, any method of restraint used during deportation will be deemed justified.
In the ongoing lawsuit seeking state compensation, the defendant, the government, submitted its first substantive written statement on June 20th.The fact that the content is similar to the prosecution's argument for not indicting, and that the timing coincides, suggests that the prosecution and the government are coordinating.I am certain of that.
We believe that this decision not to prosecute is...We strongly protest this, as it constitutes collusion between the prosecution and the government to trample on human rights and lives.
