
The 12th hearing of the Suraj case state compensation lawsuit was held at 10:00 on Wednesday, October 23, 2013. In the morning, the doctor who specializes in the heart disease (cystic tumor of the atrioventricular node: hereafter referred to as CTAVN), which is believed to be the cause of Suraj's death, was questioned, and in the afternoon, the doctor who determined the cause of Suraj's death was questioned, followed by questioning of the plaintiff, Suraj's wife.
The focus of this case was on the questioning of Dr. Ikeda, who determined in a re-examination more than two years later that the cause of Suraj's death, which was initially unknown, was CTAVN, a condition from which Suraj had originally suffered.
From the beginning of the interrogation, Dr. Ikeda was adamant that CTAVN was 100% the cause of death. One of the conditions for determining death as suffocation is that there is no other obvious cause of death, and he said that in this case, there was another obvious cause of death (CTAVN), so it was not suffocation. However, there have been cases of people living to around 90 years old while suffering from CTAVN, so when asked how he could be so sure that the fact that he had CTAVN meant that the cause of death in this case was CTAVN, he replied, "Because he died," which was completely unconvincing even for observers who do not understand medical matters.
There were also some rather rude remarks, such as "Since CTAVN exists, there is no need to consider other causes of death" and "It was his time to die," which drew criticism from the audience.
These comments from Dr. Ikeda gave the impression that the audience shared growing doubts about the cause of Suraj's death.
During the subsequent questioning of the wife, she stated directly from her own mouth what she most wanted to convey to the judge, such as, "I felt that my husband was not being treated as a human being (based on the content of the previous questioning by immigration officials)," and "I hope that I am the last person to have to go through such pain."
At the post-trial debriefing, the defense team reported that they had been able to elicit mostly the statements they had hoped for in the current questioning, and shared their intention to move forward toward the next closing argument.
