
As we recently reported on this website, on July 3, 2012, the immigration officer who had been referred to prosecutors in December 2010 in connection with the repatriation of Suraj at government expense was not indicted.
Today we held a "One-Day Protest Action" to protest this unjust decision not to prosecute.
The fifth hearing in the state compensation lawsuit was held at 11:30 in courtroom 705 of the Tokyo District Court, and once again the public gallery was full. This hearing concluded with only confirmation that, since a decision not to prosecute had been made between hearings, the Chiba District Public Prosecutors Office would review and examine the records it had previously held.
At 12:00, the meeting moved to the Bar Association building, where the defense team explained the reasons for the Chiba District Public Prosecutors Office's decision not to prosecute (including the finding that a re-examination revealed a heart condition in Ms. Suraju, which was the cause of death). They also stated that future plans include carefully reviewing any new expert reports issued after the criminal proceedings, and considering a review by the Public Prosecutors' Review Board.
At 3 PM, we held a protest action in front of the Chiba District Public Prosecutors Office. We submitted the letter of protest, which I had previously posted on this blog, to the Chiba District Public Prosecutors Office. The prosecutor in charge was absent, but Mrs. Suraj handed it directly to the clerk. Although criminal charges have already been put forward, the Chiba District Public Prosecutors Office's decision not to prosecute, based on "no suspicion," is an unusual one and makes us feel that they are protecting their own people. We must resolutely protest against such unjust decisions.
